Background

The Bird Rock Maintenance Assessment District provides enhanced maintenance services in addition to what the City of San Diego is already providing. The services include maintenance of the public landscaping as part of the traffic calming improvements (La Jolla Boulevard and the residential side streets), as well as graffiti removal, sidewalk sweeping, and minor capital improvements.

The District is locally managed by the Bird Rock Community Council who is responsible for preparing the annual draft budget, retaining contractors, and overseeing and administering the maintenance services.

The City holds the assessment funds; disperses reimbursements to the BRCC on verified and allowed expenses; conducts a quarterly inspection; and, reviews an annual audit of the BRCC financial records. 

History

In September 2004 the community initiated the formation of an assessment district. The goal was to assume responsibility for maintenanance of the public landscaping component of the traffic calming improvements along La Jolla Boulevard and in the residential streets.  The effort culminated in March 2005 as over 30% of the property owners signed a petition agreeing to the formation of the district.

Bird Rock was the first to meet the City's new program (Council Policy 100-21) whereby the City advanced the cost of forming the district ($38,000) in exchange for repayment with the first year assessment.

The community formally supported formation by a mail-in ballot process in July. In August 2005 the San Diego City Council certified the ballots and approved the formation of the Bird Rock Maintenance Assessment District.

The ballot included approval of a maximum assessment of $90 per year per single family home (maximum for condominums is $54 per year and an average of about $460 per commercial property).
The District covers the Bird Rock area from La Canada south to Turquoise, from Folsom and Linda Rosa west to the ocean.

The purpose of the Bird Rock Maintenance Assessment District is to provide enhanced maintenance services in addition to what the City of San Diego is already providing. The services include maintenance of the landscaping that will be put in with the traffic calming improvements, as well as graffiti removal, sidewalk sweeping, and minor capital improvements.

The community also supported the BRCC managing the district under contract to the City of San Diego in lieu of management by city staff. With the certification of the ballot, the BRCC initiated negotiations with the City of San Diego for a maintenance agreement which successfully concluded with the first annual contact. The City has annually renewed the BRCC's contract.

The BRCC first took over initial maintenance responsibilities in Spring 2006 and assumed responsibility for all landscaping in 2009.
